Unless otherwise specified or clearly recognizable, all content available on this Application is owned by or provided by the Owner or its licensors. The Owner takes the utmost care to ensure that the content available on this Application does not violate applicable law or third-party rights. However, it is not always possible to achieve this result. In such cases, without prejudice to legally enforceable rights and claims, Users are requested to submit the relevant complaints via the contact details specified in this document.

 

Rights on the content of this Application

The Owner holds and expressly reserves all intellectual property rights to the aforementioned content. Users are not authorized to use the content in any way that is not necessary or implicit in the correct use of the Service. In particular, but without exclusion, Users are prohibited from copying, downloading, sharing beyond the limits specified below, modifying, translating, processing, publishing, transmitting, selling, sublicensing, transforming, transferring/assigning to third parties, or creating derivative works from the content available on this Application, allowing third parties to undertake such activities through their own User account or device, even unknowingly. Where expressly indicated on this Application, the User is authorized to download, copy, and/or share certain content available on this Application exclusively for personal and non-commercial purposes and provided that the paternity of the work is observed as well as the indication of any other relevant circumstance required by the Owner. The limitations and exclusions provided by copyright law remain in force.

Through this Application, Users may have access to resources provided by third parties. Users acknowledge and accept that the Owner has no control over such resources and therefore is not responsible for their content and availability. The conditions applicable to resources provided by third parties, including those applicable to any rights concessions on content, are determined by the third parties themselves and governed by their respective terms and conditions or, in their absence, by law.

 

Allowed use

This Application and the Service may only be used for the purposes for which they are offered, according to these Terms and under applicable law. It is the sole responsibility of the User to ensure that the use of this Application and/or the Service does not violate the law, regulations, or the rights of third parties. Therefore, the Owner reserves the right to take any measures necessary to protect its legitimate interests, and in particular to deny the User access to this Application or the Service, terminate contracts, report any objectionable activities carried out through this Application or the Service to the competent authorities – e.g. judicial or administrative authorities – whenever the User engages in or there is suspicion of engaging in:

 

violations of laws, regulations, and/or the Terms;

injuries to third-party rights;

acts that may significantly prejudice the legitimate interests of the Owner;

offenses against the Owner or a third party.

Some of the Products offered on this Application, as part of the service, are provided for a fee. The rates, duration, and conditions applicable to the sale of such Products are described below and in the respective sections of this Application.

Although the Products on this Application are presented with the utmost technical accuracy possible, the representation through photos, images, colors, sounds, or any other means is to be understood as a mere reference and does not imply any warranty as to the characteristics of the purchased Product. The features of the selected Product will be specified during the purchase procedure.

 

Purchase procedure

Each phase, from product selection to order submission, is part of the purchase procedure. The purchase procedure includes the following steps:

 

Users are requested to choose the desired Product and verify their purchase choice.

After checking the information visible in the purchase choice, Users can place the order by submitting it.

 

Order submission

Submitting the order entails the following:

 

The submission of the order by the user determines the conclusion of the contract and gives rise to the User's

 

 obligation to pay the price, taxes, and possible additional costs and expenses, as specified on the order page.

In case of non-payment, the order will not be processed.

 

Order processing

Once the order has been received, the Owner will verify its accuracy and completeness and prepare for its execution. The Owner may contact Users via the email address provided to request further information or to integrate missing information. Orders will be processed within the time stated on this Application or, if not specified, within a reasonable time. The Owner will process the order until all the Products ordered are available.

 

Delivery

The Products will be delivered to the address provided by the User during the purchase procedure in the manner specified on this Application or through communication between the Owner and the User. The User undertakes to promptly check the received Products and to promptly report any defects or non-conformities, under penalty of forfeiture of this right.

 

Prices

The prices shown on this Application include any applicable taxes or fees, unless otherwise stated. Users are responsible for any additional taxes or costs, including those relating to import or customs duties, if they are not specifically indicated in the order confirmation as included.

 

Accuracy of billing and account information

The User undertakes to provide complete, accurate, and up-to-date purchase and account information for all purchases made on this Application. The User agrees to promptly update their account and other information, including their email address and credit card numbers and expiration dates, so that the Owner can complete transactions and contact the User as needed. For more details, please refer to the Privacy Policy of this Application.

 

Payment methods

The methods of payment for the Products are described in the payment section of this Application. Some payment methods may only be available subject to additional conditions or fees. In such cases, the conditions applicable to those specific cases are indicated below.

 

Promotional vouchers

Promotional vouchers are vouchers that can be used to purchase Products under the conditions specified in the promotional voucher itself. Promotional vouchers can only be used once. The Owner reserves the right to invalidate promotional vouchers at any time in the event of suspected fraud, misuse, or violation of these Terms. Promotional vouchers cannot be combined. The use of promotional vouchers may be subject to specific conditions set by the Owner. Such conditions will be made available to the User before the purchase.

 

User rights and rights of withdrawal

 

Consumer rights

Users acting as Consumers may withdraw from the contract concluded with the Seller through this Application within the time limit specified below, for any reason and without the need to provide explanations.

 

Return procedure

To exercise the right of withdrawal, the User must send an unequivocal statement of their decision to withdraw from the contract within the time limit specified above. To this end, the User can use the withdrawal form attached to these Terms, but it is not mandatory. To comply with the withdrawal deadline, it is sufficient for the User to send the communication concerning the exercise of the right of withdrawal before the withdrawal period has expired. The User is responsible for the direct cost of returning the Products, except in cases where the Owner has expressly exempted them from this cost or where the Owner has failed to inform the User that they are responsible for bearing these costs. The User must send the Products back without undue delay and in any case within 14 days from the day on which they communicated their withdrawal from this contract to the Owner. The deadline is met if the User sends back the Products before the period of 14 days has expired. The direct costs of returning the Products are borne by the User. If the User exercises the right of withdrawal, all payments made to the Owner will be refunded, including delivery costs (except for the additional costs resulting from the User's choice of a type of delivery other than the least expensive type of standard delivery offered by the Owner), without undue delay and in any case no later than 14 days from the day on which the Owner is informed of the User's decision to withdraw from this contract. These refunds will be made using the same means of payment used by the User for the initial transaction unless the User has expressly agreed otherwise; in any case, the User will not incur any fees as a result of such reimbursement. The refund may be suspended until receipt of the goods or until the User provides evidence of having sent back the goods, whichever occurs first.

 

Exceptions to the right of withdrawal

The right of withdrawal does not apply to the following contracts, unless the parties have expressly agreed otherwise:

 

Contracts for the supply of sealed goods that are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery;

Contracts for the supply of goods that are likely to deteriorate or expire rapidly;

Contracts for the supply of goods which are, after delivery, according to their nature, inseparably mixed with other items;

Contracts for the supply of sealed audio or sealed video recordings or sealed computer software that were unsealed after delivery;

Contracts for the supply of digital content that is not supplied on a tangible medium if the performance has begun with the User's prior express consent and the User has acknowledged their loss of the right of withdrawal as a result;

Contracts concluded at a public auction;

Contracts for the provision of accommodation for non-residential purposes, transport of goods, car rental services, catering services, or services related to leisure activities, if the contract provides for a specific date or period of performance.

Effects of withdrawal

If the User withdraws from this contract, all payments made to the Owner will be refunded, including delivery costs (except for the additional costs resulting from the User's choice of a type of delivery other than the least expensive type of standard delivery offered by the Owner), without undue delay and in any case no later than 14 days from the day on which the Owner is informed of the User's decision to withdraw from this contract. These refunds will be made using the same means of payment used by the User for the initial transaction unless the User has expressly agreed otherwise; in any case, the User will not incur any fees as a result of such reimbursement. The refund may be suspended until receipt of the goods or until the User provides evidence of having sent back the goods, whichever occurs first.

 

Grounds for suspension

The right of withdrawal is excluded in the following cases:

 

the provision of services, after the service has been fully performed, if the performance has begun with the consumer's prior express consent and with the acknowledgment that the right of withdrawal will be lost once the contract has been fully performed by the professional;

the supply of goods or services, the price of which is dependent on fluctuations in the financial market which cannot be controlled by the professional and which may occur within the withdrawal period;

the supply of goods made to the consumer's specifications or clearly personalized;

the supply of goods which are liable to deteriorate or expire rapidly;

the supply of sealed goods which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery;

the supply of goods which are, after delivery, according to their nature, inseparably mixed with other items;

the supply of alcoholic beverages, the price of which has been agreed upon at the time of the conclusion of the sales contract, the delivery of which can only take place after 30 days and the actual value of which is dependent on fluctuations in the market which cannot be controlled by the professional;

contracts where the consumer has specifically requested a visit from the professional for the purpose of carrying out urgent repairs or maintenance. If, on the occasion of such visit, the professional provides services additional to those specifically requested by the consumer or goods other than replacement parts necessary for the performance of maintenance or repairs, the right of withdrawal shall apply

 

 to those additional services or goods;

the supply of sealed audio or sealed video recordings or sealed computer software which were unsealed after delivery;

the supply of a newspaper, periodical, or magazine with the exception of subscription contracts for the supply of such publications;

contracts concluded at a public auction;

the provision of accommodation for non-residential purposes, transport of goods, car rental services, catering services, or services related to leisure activities, if the contract provides for a specific date or period of performance.
